German Court Decides That FlightScope Product Violates TrackMan’s Patent Rights

VedbÆk, Denmark, May 7, 2013 – The District Court of Düsseldorf in Germany has today ruled in favor of TrackMan A/S in the lawsuit – 4a O 169/11 – filed in December 2011 against MIA Sports Technology Ltd.

The lawsuit relates to infringement of TrackMan’s patent, EP 1 698 380 concerning a method for estimating the rotational velocity or spin frequency of a rotating sports ball in flight. The case was originally based on MIA Sports Technology Ltd.’s sale of FlightScope golf tracking radar model “X2” with the then current software version (5.8) and the ruling covers any products measuring the spin frequency of a flying sports ball using the features set out in the ruling (Infringing Products).

According to the ruling, MIA Sports Technology Ltd. shall (i) refrain from marketing, offering for sale, using, owning or importing Infringing Products in Germany; (ii) account for all past sales of Infringing Products, since TrackMan A/S obtained its German patent on 14 November 2009; (iii) recall and remove from the market place all Infringing Products sold since the patent was granted in Germany; and (iv) pay damages as well as costs of the legal dispute to TrackMan A/S. The ruling of the District Court of Düsseldorf may be appealed.

Besides Germany, TrackMan has been granted patents corresponding to EP 1 698 380 in the UK, France, China, South Korea, and Japan, and a related patent application is currently being prosecuted in the US.

A valid patent may generally be enforced against a party who manufactures, sells, or makes commercial use of a product which infringes the patent in the relevant jurisdiction.
