TrackMan's Technology For Measuring The Spin Of A Sports Ball Is Protected By EP 1 698 380 (DE 60 2006 009 719)

VedbÆk, Denmark, September 14th, 2015 – The Federal Patent Court in Germany has recently delivered a judgment confirming the validity of the patent with modified claims in nullity proceedings (1 Ni 18/14 (EP)), which were initiated by MIA Sports Technology Ltd. (MIA). MIA has to bear ¾ of the costs of the proceedings, Trackman ¼. The decision can be appealed.
The original version of TrackMan’s European spin patent formed the basis for the legal ruling in favor of TrackMan A/S on May 7, 2013 (4a O 169/11), in connection with a patent infringement lawsuit filed by TrackMan A/S at the District Court of Düsseldorf in Germany against MIA Sports Technology Ltd. (MIA) based on MIA’s distribution and sale of FlightScope’s golf tracking radar model “X2” (including its software version (5.8)).
The ruling of the District Court of Düsseldorf has been appealed by MIA (I-15 U 11/14). The lawsuit is still pending.
“We are very pleased with the German Federal Patent Court’s decision to maintain our European Spin Patent as modified by us during the proceedings”, says Klaus Eldrup-Jørgensen, CEO of TrackMan A/S.
“Our original European spin patent formed the basis for our victory in the lawsuit against MIA based on MIA’s sale of FlightScope’s golf tracking radar model “X2″ (including its software version (5.8)) and with the recent decision by the German Federal Patent Court, we are now in a position to continue the infringement proceedings against MIA. We are optimistic that on this basis the Court of Appeal in Düsseldorf will confirm and support the previous ruling of the District Court of Düsseldorf in the infringement case”, Klaus Eldrup-Jørgensen adds.
Besides Germany, TrackMan has been granted corresponding patents on its spin measurement technology in the US, UK, France, China, South Korea and Japan. In particular, TrackMan’s issued US patent No. 8,845,442 B2 to Fredrik Tuxen, entitled “Determination of spin parameters of a sports ball”, which is assigned to TrackMan A/S, provides coverage which equals if not exceeds TrackMan’s European spin patent.
